(“fix,” “we,” or “us”), collectively referred to as the “Platform.” The services we offer include (a) the Platform itself and (b) the services provided through the Platform by fix. Any new features added to the Services are also subject to these Terms. By using the Platform, you agree to these Terms.

1. Acceptance of Terms

Please read these Terms carefully. By accessing and using the Platform, you confirm that you have read, understood, and accepted the Terms and consent to the processing of your personal data as outlined in our Privacy Policy. If you do not agree with these Terms, do not use the Platform or the Services.

2. Changes to Terms

fix reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting on the website. Your continued use of the website following any such change constitutes your acceptance of the new Terms.

3. Use of the Platform

3.1. Account Registration

To access certain features of the Platform, you may be required to provide personal information, including a valid email address, mobile phone number, and a unique password. This information is essential for creating and managing your account. When making a purchase or placing an order, depending on the payment method you choose, you may also need to provide us with your credit card details or other payment information.

You may not use, copy, or distribute these Trademarks without our prior written consent. Unauthorized use on other websites or platforms is strictly prohibited. fix will enforce its intellectual property rights to the fullest extent of the law. Use of materials on the Platform is at your own risk.

5. Limitation of Liability

To the fullest extent permitted by applicable law, Oceanic Dolphin Pte. Ltd. (referred to as “fix,” “we,” or “us”) and our affiliates, officers, directors, employees, agents, licensors, and service providers will not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the Platform or Services; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from the Platform; (d) any bugs, viruses, trojan horses, or similar harmful code that may be transmitted to or through the Platform by any third party; (e) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, transmitted, or otherwise made available through the Platform; and/or (f) the defamatory, offensive, or illegal conduct of any third party.

In no event shall our total liability to you for all claims related to the Platform or Services exceed the amount you paid, if any, to us for the specific service in question during the three (3) months preceding the event giving rise to the liability.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you. In such cases, our liability will be limited to the fullest extent permitted by law.

6. Governing Law

These Terms of Use and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Singapore, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Singapore for the resolution of any disputes arising out of or relating to these Terms or your use of the Platform or Services.

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of fix.

7. User Eligibility

The Platform may be used by (i) individuals who are at least 18 years old and (ii) corporate legal entities. Country-specific provisions may apply to these Terms where relevant.

Users under 18 must have consent from a parent or legal guardian, who must accept these Terms and agree to be responsible for the user’s actions and any charges incurred. If you do not have this consent, stop using the Platform immediately.

8. Security and Verification

You acknowledge that fix, or a third party on behalf of fix, may conduct Background Checks on you without further notice. “Background Checks” may include, but are not limited to, checks for government or financial sanctions, civil or criminal litigation, or adverse news. If fix, at its sole discretion, is not satisfied with the results, your fix account and access to the Platform may be terminated.

9. Third-Party Links and Services

The Platform may include links to third-party products, websites, services, and offers. By clicking on these links, you acknowledge that you do so at your own risk. These third-party links, products, websites, and services are not owned or controlled by us. We neither manage nor endorse these third-party websites or links and are not responsible for their content, functionality, security, services, privacy policies, or other practices. We disclaim any liability or responsibility for any loss or damage you may incur as a result of accessing or using these third-party links and websites.

10. Termination of Use

We reserve the right to terminate or suspend your access to the Platform, at our sole discretion, without prior notice, for any reason, including but not limited to the following:

- Violation of these Terms of Use or any other applicable terms and conditions or policies.

- Conduct that we believe is harmful to other users, third parties, or our business interests.

- Unauthorized use of the Platform, including but not limited to the misuse of your account or sharing your password with others.

- Engaging in activities that may cause harm to the Platform, including but not limited to hacking, introducing malware, or attempting to disrupt the functionality of the Platform.

Upon termination, your right to access and use the Platform will immediately cease. We may, at our discretion, also remove and discard any content or data you have provided, and we are under no obligation to retain any information associated with your account.

If your account is terminated for any reason, you are prohibited from creating a new account without our express written permission. We reserve the right to take legal action if necessary to enforce this prohibition.

Termination of your access to the Platform does not waive or affect any rights or remedies we may have under the law or these Terms of Use. We may also report any unlawful activities to the appropriate authorities.

If you wish to terminate your account, you may do so by contacting us directly. Upon our confirmation, your account will be deactivated, and your access to the Platform will be terminated.

11. Data Protection and Privacy

We are committed to protecting your privacy and personal data. All personal data provided through the Platform will be processed and stored in accordance with our Privacy Policy. We implement appropriate technical and organizational measures to ensure the security of your data against unauthorized access, loss, or misuse.

All photos and images of the Services on the Platform are for illustrative purposes only.

When you place an order through the Platform, you agree to provide accurate and complete information, including your contact details, delivery address, and any specific instructions relevant to the order. It is your responsibility to ensure that all information provided is correct and up-to-date to facilitate the smooth processing of your order.

Upon receiving your order, the vendor will review the details and schedule the service or delivery. The vendor will then update you with the relevant contact information and any additional details necessary for the execution of your order. This may include confirmation of the service date and time, delivery estimates, or any other pertinent information.

The execution of your order will proceed according to the schedule provided by the vendor. During this time, you may receive updates regarding the status of your order, including any changes to the schedule or additional instructions.

Once the service has been executed or the service has been delivered, the order will be marked as complete. You may be required to confirm receipt of the service, and if applicable, provide feedback on your experience.

It is essential that you are available and reachable via the contact information you provided during the order placement to ensure smooth communication throughout the process. Failure to respond to communication from the vendor may result in delays or cancellation of your order.

In the event of any issues or discrepancies with your order, you are encouraged to contact the vendor directly or reach out to our support team for assistance. We are committed to ensuring that your experience on our Platform meets your expectations.

13. Defect Liability Period

All services provided through our Platform are subject to a defect liability period, which begins upon the completion of the service. The duration of this period is clearly specified for each service and is displayed before you place your order.

During the defect liability period, if any issues or defects arise that are directly related to the service provided, you may contact the vendor to request rectification. The vendor is obligated to address any valid defects in the service at no additional cost to you, provided that the defects are reported within the specified defect liability period.

To report a defect, you should contact the vendor directly using the contact information provided during the order process. Be sure to include all relevant details, such as the nature of the defect, any supporting evidence (e.g., photos or documentation), and the date the service was completed.

The vendor will assess the reported defect and determine the appropriate course of action, which may include repairing, redoing the service, or providing an alternative solution. The vendor is expected to respond to defect reports promptly and resolve them within a reasonable timeframe.

Please note that the defect liability period only covers issues that are directly related to the quality or execution of the service as originally agreed upon. It does not cover issues arising from misuse, neglect, or any modifications made by you or third parties after the service was completed. Additionally, if a defect is reported that is determined to be outside the scope of the defect liability period or not relevant to the service provided, a surcharge may be applied for any corrective actions requested by you. This surcharge will be determined by the vendor and communicated to you before any additional work is carried out.

If the defect liability period expires, the vendor is no longer obligated to address any defects or issues related to the service. Therefore, it is important to report any concerns within the designated timeframe.

Our platform is committed to ensuring that all services meet a high standard of quality. However, the ultimate responsibility for addressing defects during the liability period lies with the vendor who provided the service. Please be aware that surcharges may apply for any work requested beyond the scope of the original service agreement.

14. Payment, Refunds and Rebates

14.1. Payment

All payments made through the Platform are subject to our payment terms. We accept various payment methods as displayed at the time of purchase, including credit/debit cards and digital payment platforms. By providing your payment information, you authorize us to charge the total amount due for your order to your chosen payment method.

It is your responsibility to ensure that the payment information you provide is accurate and up-to-date. We are not responsible for any delays or failures in processing payments due to incorrect or expired payment details.

14.2. Refunds

Refunds, if applicable, will be processed according to our refund policy, which is available upon request. If you are not satisfied with a Service provided through the Platform, please contact our support team at support@fix.com.sg within 7 days of receiving the service.

Refunds will be issued to the original payment method used for the purchase. Please note that it may take [refer to mobile application timeframe as specified] for the refunded amount to appear in your account, depending on your payment provider.

Credit card holders will receive the refunded amount in their next billing cycle. For debit cards, the amount will be returned within 30-60 days.

In cases where a refund is not applicable, we may offer alternative solutions such as service credits or a re-performance of the Service, at our discretion.

14.3. Rebates

The "Let's Fix Together" event offers a cash rebate of up to 75% on eligible orders. The event is governed by the following terms and conditions:
